Privacy Policy
This Privacy Policy explains how Equity Cheq LLC (“Equity Cheq,” “we,” “us,” or “our”), including its brands and websites such as InvestorCheq, collects, uses, shares, and protects information in connection with our websites, booking tools, communications, and services (collectively, the “Services”).
By accessing or using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.
Equity Cheq LLC is located at 1504 Bay Rd, Miami Beach, FL 33139. For any privacy questions or requests, contact us at admin@equitycheq.com.
1. Who We Are and What We Do
Equity Cheq provides investor-acquisition services to real estate sponsors and fund managers (“Sponsors”). As part of these Services, we identify, contact, and screen prospective accredited investors (“Investors”) and, where appropriate, facilitate introductions and meetings between Investors and Sponsors.
This means we collect and process information from two broad groups of people: (a) Sponsors and prospective Sponsors who engage or inquire about our Services, and (b) Investors and prospective Investors whom we contact, screen, or who engage with our campaigns and communications. This Policy applies to all of them.
2. Information We Collect
We collect the following categories of information:
Information you provide directly. When you book a call, complete a form, respond to an ad or outreach, or communicate with us, you may provide your name, email address, phone number, company or firm name, professional role, and information about your investment activity, capital-raising needs, or areas of interest. Investors may also provide information relating to accreditation status and investment preferences.
Information collected automatically. When you visit our websites, we and our service providers may automatically collect technical information such as IP address, browser type, device type, operating system, referring pages, and general usage data, through cookies and similar technologies. We use these for site functionality, security, and basic analytics. We do not use tracking technologies for cross-site behavioral advertising or retargeting.
Information from third parties. We may receive or compile information about prospective Investors and Sponsors from advertising platforms, lead-generation forms, publicly available sources, business databases, and referrals, consistent with applicable law.
We do not knowingly collect sensitive personal information beyond what is reasonably necessary to provide the Services, and we do not knowingly collect information from anyone under 18. The Services are intended for business and professional use by adults.
3. How We Use Information
We use information to:
- Provide, operate, and improve the Services;
- Contact, qualify, and screen prospective Investors, and confirm accreditation status where relevant;
- Facilitate and schedule meetings, and communicate about appointments and inquiries;
- Introduce qualified Investors to Sponsors as part of the Services;
- Send transactional communications such as booking confirmations, reminders, and follow-ups;
- Respond to your inquiries and provide support;
- Conduct marketing and outreach consistent with applicable law and your preferences;
- Maintain the security and integrity of the Services, and detect and prevent fraud or misuse;
- Comply with legal obligations and enforce our agreements.
We rely on legitimate business interests, your consent where required, the performance of a contract, and compliance with legal obligations as bases for processing, as applicable.
4. How We Share Information
We share information in the following circumstances:
With Sponsors. A core function of our Services is connecting qualified Investors with Sponsors. Where an Investor is qualified and interested, we share relevant Investor contact and interest information with the applicable Sponsor so that a meeting or relationship can proceed. Investors who engage with our Services understand that their information may be shared with Sponsors for this purpose.
With service providers. We share information with vendors who perform services on our behalf, including customer-relationship and automation platforms, email and communications providers, advertising platforms, calendar and scheduling tools, hosting and infrastructure providers, and analytics providers. These providers are permitted to use information only to perform services for us.
For legal and safety reasons. We may disclose information where required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or respond to a government request.
In connection with a business transaction. If Equity Cheq is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
We do not sell your personal information for money. To the extent certain data-sharing for advertising is treated as a “sale” or “sharing” under specific state laws, we honor applicable opt-out rights as described in Section 8.
5. Communications and Consent
By providing your contact information and engaging with our Services, you agree that we may contact you by phone, email, and text message regarding your inquiry, appointment, or relationship with us. Message and data rates may apply to text messages. You can opt out of marketing emails by using the unsubscribe link, and out of text messages by replying STOP. Transactional messages necessary to provide a service you requested (such as an appointment confirmation) may continue after you opt out of marketing.
We maintain telephone and messaging practices consistent with applicable law, including the Telephone Consumer Protection Act and CAN-SPAM Act.
6. Cookies and Similar Technologies
Our websites use cookies and similar technologies for essential functionality, security, and basic analytics. You can control cookies through your browser settings; disabling certain cookies may affect site functionality. Because we do not use cross-site advertising trackers, we do not serve retargeted advertising based on your browsing of our sites.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to provide the Services, to comply with our legal, tax, and regulatory obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed, we take reasonable steps to delete, anonymize, or securely store it.
8. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information, including the right to request access to, correction of, or deletion of your information, and the right to opt out of certain processing. Residents of certain states, including under the Florida Digital Bill of Rights and similar laws, may have additional rights.
To exercise any of these rights, contact us at admin@equitycheq.com. We will respond consistent with applicable law and may need to verify your identity before acting on a request. We will not discriminate against you for exercising your rights.
If you are located outside the United States, please be aware that information we collect is processed and stored in the United States, where privacy laws may differ from those in your jurisdiction.
9. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials and communications secure on your end.
10. Third-Party Links and Services
Our Services may link to or integrate with third-party websites and tools that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you use.
11. Children’s Privacy
The Services are intended for adults engaged in professional and business activities. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected such information, we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be indicated as appropriate. Your continued use of the Services after an update constitutes acceptance of the revised Policy.
